1. General information

1.1 The organiser of the test campaign is Tokuyama Dental Deutschland GmbH, Fürstengrund 14, 48629 Metelen, Germany (hereinafter "Organiser").

1.2 These Terms and Conditions of Participation govern the Organiser's terms and conditions towards you as an applicant ("Applicant") or participant ("Product Tester") in the test campaign.

1.3 By applying and participating as a product tester, the applicant accepts these conditions of participation.

1.4 The organiser reserves the right to change these conditions of participation without prior notice.

2. Application and participation as a product tester

2.1 Dentists and dental technicians with a dental office or laboratory address in the following countries are eligible to participate: https://tokuyama-dental.eu/en/company/partner/ Dealers are excluded from participation.

2.2 Application and participation in the product test are free of charge and are not linked to a purchase obligation.

2.3 Applications must be submitted using the online form at the following link: https://tokuyama-dental.eu/en/estecem-ii-plus-trial-kit/ and is possible up to and including 31st December 2024 or while stocks last.

2.4 By participating in the product test, the applicant agrees to use the test product as recommended in the corresponding instructions for use.

3. Implementation and processing of the product test

3.1 The applicants' contact details will be passed on to our sales partners in the following countries: https://tokuyama-dental.eu/en/company/partner/ The relevant sales partner will then contact the product tester and arrange an appointment for the personal delivery of the test sample** including application training. ESTECEM II PLUS Paste Universal (2.4g) / bottle UNIVERSAL BOND A (1ml) / bottle UNIVERSAL BOND B (0.8ml) / 10 x mixing tips / 5 x mixing tips S / 5 x nozzle for mixing tip S / 25 x micro brushes / 1 x mixing dish / 5 x disposable mixing dishes

3.2 There is no entitlement to participate in the product test. If the number of applicants selected in point 3.1 exceeds the number of test products available, the organiser reserves the right to end the test campaign prematurely.

3.3 Only one person per dental office or dental laboratory can take part in our product test. Only one product can be tested per product tester. The right to participate in the product test cannot be assigned or transferred. The product cannot be paid out or changed.

3.4 If circumstances arise for which we are not responsible, the respective product tester will accept an appropriate replacement product.

4. Exclusion

4.1 A violation of these conditions of participation entitles us to exclude the respective applicant / product tester from the product test. This applies in particular if the applicant provides false information, violates applicable law or the rights of third parties and in the case of comments that violate netiquette.

4.2 If the excluded applicant is a participating product tester who has already been selected, participation in the product test may be subsequently cancelled.

5. Premature termination or cancellation of the product test

5.1 The Organiser is entitled to terminate, suspend or change the product test prematurely if unforeseen circumstances arise that are beyond the Organiser's control and make the original implementation more difficult or unreasonable for the Organiser.

5.2 The above 5.1. applies accordingly if it is not possible for the organiser to carry out the product test properly for legal reasons or if difficulties arise that jeopardise the integrity of the product test.

6. Liability of the organiser

Any liability for damages on the part of the organiser in connection with the product test is limited to cases of intent or gross negligence to the extent permitted by law.

7. Data protection

7.1 The personal data collected from the applicant and product tester will be stored and used exclusively for the purpose of carrying out and processing the product test and only with the applicant's prior unambiguous consent by ticking the box in the application form. Consent can be revoked at any time.

8. Final provisions

8.1 Should individual provisions of these conditions of participation be or become invalid, this shall not affect the validity of the remaining provisions.

8.2 The Organiser also reserves the right to amend these Terms and Conditions of Participation without prior notice.

8.3 Legal recourse is excluded.
